เงื่อนไขการยกเลิกบริการ การเลื่อนนัด การคืนเงินตามขั้นตอนของงาน แพ็กเกจรายปี ระบบเหยื่อกำจัดปลวก การชำระด้วยบัตรที่ออกในต่างประเทศ และการโต้แย้งการชำระเงิน — อ่านคู่กับ ข้อกำหนดและเงื่อนไขการใช้บริการ WERT

ข้อ 1 — ขอบเขตของนโยบาย และความสัมพันธ์กับข้อกำหนดและเงื่อนไขการใช้บริการ WERT
1.1 นโยบายนี้ใช้บังคับกับบริการทุกประเภทของ WERT (เช่น บริการกำจัดปลวกระบบอัดน้ำยา บริการกำจัดปลวกระบบวางท่อน้ำยา บริการระบบเหยื่อกำจัดปลวก บริการกำจัดแมลงทั่วไป และบริการสำหรับพื้นที่ธุรกิจ) ในพื้นที่ให้บริการจังหวัดชลบุรีและระยอง ไม่ว่าท่านจะติดต่อสั่งซื้อผ่านช่องทางใด (LINE, โทรศัพท์, พบเจ้าหน้าที่, เว็บไซต์ หรือช่องทางออนไลน์อื่นเมื่อเปิดให้บริการ)
1.2 นโยบายนี้เป็นส่วนหนึ่งของ "ข้อกำหนดและเงื่อนไขการใช้บริการ WERT" ในเรื่องการยกเลิก การเลื่อนนัด การคืนเงิน และข้อโต้แย้งการชำระเงิน ให้ถือข้อความในนโยบายนี้เป็นข้อความเฉพาะที่ใช้บังคับก่อน
1.3 ใบเสนอราคาและสัญญาบริการของแต่ละงานอาจกำหนดรายละเอียดเฉพาะงาน (เช่น จำนวนรอบบริการ ระยะเวลารับประกัน ขอบเขตพื้นที่) ให้อ่านเอกสารเฉพาะงานประกอบกับนโยบายนี้ หากขัดกันในตัวเลขหรือขอบเขตเฉพาะงาน ให้ถือตามเอกสารเฉพาะงาน เว้นแต่จะทำให้ท่านได้รับความคุ้มครองน้อยกว่าที่กฎหมายกำหนด ทั้งนี้ สำหรับผู้บริโภค เอกสารเฉพาะงานจะลดความคุ้มครองที่ระบุไว้ในนโยบายฉบับเผยแพร่นี้ได้ เฉพาะเมื่อข้อแตกต่างนั้นถูกเน้นให้เห็นอย่างชัดเจนเป็นการเฉพาะ ได้รับการยอมรับหรือลงนามแยกต่างหาก และมีเหตุอันสมควรจากลักษณะของงานนั้น มิฉะนั้นให้ถือตามนโยบายฉบับเผยแพร่นี้
1.4 ไม่มีข้อความใดในนโยบายนี้ที่มีวัตถุประสงค์จำกัดหรือตัดสิทธิที่ท่านมีอยู่ตามกฎหมาย ซึ่งรวมถึงประมวลกฎหมายแพ่งและพาณิชย์ พระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 พระราชบัญญัติว่าด้วยข้อสัญญาที่ไม่เป็นธรรม พ.ศ. 2540 และ (ในกรณีที่ใช้บังคับ) พระราชบัญญัติขายตรงและตลาดแบบตรง พ.ศ. 2545 หากข้อความใดขัดต่อกฎหมายที่มีผลบังคับ ให้ข้อความนั้นสิ้นผลเฉพาะส่วนที่ขัด โดยข้อความส่วนที่เหลือยังมีผลใช้บังคับต่อไป
1.5 นโยบายนี้จัดทำเป็นภาษาไทยและภาษาอังกฤษ ทั้งสองฉบับมีเนื้อหาตรงกัน หากมีข้อแตกต่างในการตีความ ให้ยึดฉบับภาษาไทยเป็นหลักเท่าที่กฎหมายที่ใช้บังคับอนุญาต
ข้อ 2 — คำนิยาม และการแยกประเภทเรื่องที่เกี่ยวกับเงิน 8 ประเภท
เพื่อให้การติดต่อรวดเร็วและตรงเรื่อง WERT แยกเรื่องที่เกี่ยวกับเงินออกเป็น 8 ประเภท ซึ่งมีขั้นตอนและผลทางกฎหมายต่างกัน ดังนี้
2.1 การคืนเงินที่ WERT อนุมัติ (WERT-approved Refund) — การที่ WERT ตกลงคืนเงินทั้งหมดหรือบางส่วนให้ท่านตามนโยบายนี้ ตามสัญญา หรือตามกฎหมาย โดยคืนผ่านช่องทางเดิมที่ท่านชำระ (ข้อ 9)
2.2 การยกเลิกโดยลูกค้า (Customer Cancellation) — การที่ท่านแจ้งยกเลิกบริการที่สั่งซื้อแล้วทั้งหมดหรือบางส่วน ผลของการยกเลิกขึ้นอยู่กับขั้นตอนของงาน ณ เวลาที่แจ้ง (ข้อ 3)
2.3 การเลื่อนนัดหมาย (Rescheduling) — การเปลี่ยนวันหรือเวลาให้บริการโดยงานยังคงอยู่ ไม่ใช่การยกเลิก และโดยหลักไม่มีการคืนเงิน (ข้อ 4)
2.4 ข้อโต้แย้งการชำระเงิน (Payment Dispute) — การที่ท่านแจ้งต่อ WERT โดยตรงว่ายอดเรียกเก็บ จำนวนเงิน หรือรายการชำระไม่ถูกต้อง เพื่อให้ WERT ตรวจสอบและแก้ไข (ข้อ 11 และข้อ 13)
2.5 การปฏิเสธรายการผ่านผู้ออกบัตร (Chargeback) — กระบวนการที่ท่านใช้สิทธิผ่านธนาคารหรือผู้ออกบัตรของท่านตามกติกาของเครือข่ายบัตร (เช่น Visa, Mastercard) เป็นกระบวนการคนละทางกับการขอคืนเงินจาก WERT (ข้อ 11)
2.6 รายการที่ไม่ได้รับอนุญาตหรือทุจริต (Unauthorized / Fraudulent Transaction) — การชำระเงินที่เกิดขึ้นโดยเจ้าของบัตรหรือเจ้าของบัญชีไม่ได้อนุญาต เช่น บัตรถูกขโมยหรือข้อมูลบัตรรั่วไหล (ข้อ 12)
2.7 การชำระเงินซ้ำซ้อน (Duplicate Payment) — การชำระเงินสำหรับรายการเดียวกันมากกว่าหนึ่งครั้ง เช่น โอนซ้ำ หรือระบบตัดบัตรซ้ำ (ข้อ 7.1)
2.8 กรณี WERT ไม่สามารถให้บริการได้ (WERT Unable to Provide Service) — กรณีที่ WERT เป็นฝ่ายไม่สามารถให้บริการตามที่ตกลง เช่น อยู่นอกพื้นที่ให้บริการ หรือไม่สามารถจัดทีมได้ (ข้อ 7.3)
2.9 สถานะการชำระเงิน ≠ สถานะนัดหมาย — "ได้รับชำระเงินแล้ว" หมายความเพียงว่า WERT ได้รับเงินของท่านแล้ว ไม่ได้แปลว่า "ยืนยันนัดหมายบริการแล้ว" การนัดหมายจะถือว่ายืนยันต่อเมื่อ WERT แจ้งยืนยันวันและเวลาให้บริการแก่ท่านอย่างชัดแจ้ง (เช่น ทาง LINE เอกสารนัดหมาย หรือระบบสมาชิก WERT) ระยะเวลาและเงื่อนไขในนโยบายนี้ที่อ้างอิง "การยืนยันนัด" ให้นับจากการแจ้งยืนยันดังกล่าว
2.10 "ค่าใช้จ่ายที่เกิดขึ้นจริง" ในนโยบายนี้ หมายถึง ค่าใช้จ่ายที่ (ก) เกิดขึ้นแล้วจริงสำหรับงานของท่านโดยเฉพาะ (ข) WERT พิสูจน์ได้ด้วยหลักฐาน เช่น ใบเสร็จ ใบสั่งซื้อ บันทึกการเบิกวัสดุ (ค) ไม่สามารถเรียกคืนหรือนำไปใช้กับงานอื่นได้ตามสมควร และ (ง) เป็นค่าใช้จ่ายที่เกี่ยวข้องเฉพาะกับส่วนของบริการที่ถูกยกเลิกหรือยังไม่ได้ให้เท่านั้น ค่าใช้จ่ายของงานส่วนที่ให้บริการแล้ว ถือว่ารวมอยู่ในมูลค่างานส่วนที่ WERT มีสิทธิได้รับไว้แล้ว และจะไม่ถูกนำมาหักซ้ำอีก การหักค่าใช้จ่ายใดจากเงินคืน WERT จะแสดงรายการและหลักฐานให้ท่านทราบทุกครั้ง
ข้อ 3 — ขั้นตอนของงานบริการ (ขั้น A–F) และผลของการยกเลิกโดยลูกค้าในแต่ละขั้น
สิทธิตามกฎหมายขายตรงและตลาดแบบตรงมาก่อนข้อนี้: สำหรับการซื้อที่อยู่ภายใต้บังคับพระราชบัญญัติขายตรงและตลาดแบบตรง พ.ศ. 2545 (เช่น การสั่งซื้อและชำระเงินออนไลน์ หากการซื้อนั้นอยู่ในบังคับของกฎหมายดังกล่าว) การบอกเลิกภายใน 7 วันนับแต่วันที่ได้รับบริการเป็นไปตามข้อ 8 — คืนเงินเต็มจำนวนภายใน 15 วัน — และการหักเงินตามขั้นตอนในข้อนี้ไม่ใช้บังคับ เว้นแต่การหักกลบเท่าที่กฎหมายอนุญาต
3.1 ตารางขั้นตอนของงาน

หมายเหตุตาราง: ตารางนี้อยู่ภายใต้ข้อ 8 — การบอกเลิกโดยชอบภายใน 7 วันตามพระราชบัญญัติขายตรงและตลาดแบบตรง พ.ศ. 2545 ได้รับคืนเงินเต็มจำนวนภายใน 15 วัน โดยไม่หักตามขั้น C–F เว้นแต่การหักกลบเท่าที่กฎหมายอนุญาต
3.2 หลักเกณฑ์รายขั้น
(ก) ขั้น A — ก่อนยืนยันวันให้บริการ: ท่านยกเลิกได้ทุกเมื่อ WERT คืนเงินที่ได้รับไว้เต็มจำนวน โดยไม่หักค่าใช้จ่ายใด ๆ
(ข) ขั้น B — ยืนยันนัดแล้ว ยังไม่เตรียมงาน: ท่านยกเลิกได้ WERT คืนเงินเต็มจำนวน ทั้งนี้ การแจ้งภายในระยะเวลาแจ้งล่วงหน้าตามข้อ 3.3 ช่วยให้งานของท่านยังอยู่ในขั้น B (ยังไม่เกิดค่าใช้จ่าย) ได้มากที่สุด
(ค) ขั้น C — มีค่าใช้จ่ายเตรียมงานจริงแล้ว: WERT คืนเงินโดยหักได้เฉพาะค่าใช้จ่ายที่เกิดขึ้นจริง พิสูจน์ได้ และเรียกคืนไม่ได้ ตามข้อ 2.10 เท่านั้น ภาระในการแสดงหลักฐานค่าใช้จ่ายเป็นของ WERT
(ง) ขั้น D — ทีมออกเดินทางแล้ว: นอกจากค่าใช้จ่ายตาม (ค) WERT อาจคิดค่าเดินทาง/ค่าออกหน่วยในอัตราที่สมเหตุสมผลและสอดคล้องกับความเสียหายที่เกิดขึ้นจริง (ตามหลักเกณฑ์ในข้อ 4.3) WERT รับทราบว่าศาลมีอำนาจปรับลดเบี้ยปรับที่สูงเกินส่วนตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 383 และตั้งใจกำหนดอัตราให้ใกล้เคียงความเสียหายจริงตั้งแต่ต้น ทั้งนี้ ค่าเดินทางและค่าออกหน่วยจะคิดภายใต้หัวข้อค่าออกหน่วยนี้เท่านั้น และจะไม่ถูกนับเป็นค่าใช้จ่ายตามข้อ 2.10 ซ้ำอีก
(จ) ขั้น E — เริ่มบริการแล้ว: เมื่อเริ่มให้บริการแล้ว ท่านยังคงยกเลิกส่วนที่เหลือได้ตามกฎหมาย (ประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 605) โดย WERT มีสิทธิได้รับค่าแห่งการงานส่วนที่ทำไปแล้ว (มาตรา 391 วรรคสาม) การคำนวณมูลค่าส่วนที่ให้บริการแล้วใช้อัตราตามแพ็กเกจ/สัญญาที่ท่านซื้อจริง ไม่ใช้ราคาบริการครั้งเดียวมาคิดย้อนหลัง สำหรับแพ็กเกจรายปีดูข้อ 5 สำหรับระบบเหยื่อดูข้อ 6 ทั้งนี้ ค่าใช้จ่ายที่หักได้มีเฉพาะค่าใช้จ่ายตามข้อ 2.10 ของส่วนที่ยกเลิก/ยังไม่ได้ให้บริการ — ค่าใช้จ่ายของงานส่วนที่ให้บริการแล้ว ถือว่ารวมอยู่ในมูลค่างานส่วนที่ WERT มีสิทธิได้รับไว้แล้ว และจะไม่ถูกนำมาหักซ้ำอีก
(ฉ) ขั้น F — งานเสร็จสมบูรณ์: ไม่มีการยกเลิกหรือคืนเงินเพราะเหตุเปลี่ยนใจภายหลังงานเสร็จ อย่างไรก็ดี (1) สิทธิเรียกร้องกรณีงานชำรุดบกพร่องตามกฎหมาย (2) สิทธิตามการรับประกันที่ระบุในใบเสนอราคา/สัญญาของงานนั้น และ (3) สิทธิเลิกสัญญาตามกฎหมายเฉพาะที่ใช้บังคับ (เช่น ข้อ 8) ยังคงอยู่ครบถ้วน หากผลงานมีปัญหา โปรดแจ้ง WERT เพื่อเข้าตรวจสอบและแก้ไขตามเงื่อนไขรับประกันก่อนเป็นลำดับแรก
3.3 ระยะเวลาแจ้งยกเลิก/เลื่อนนัดล่วงหน้า: เพื่อยกเลิกหรือเลื่อนนัดโดยไม่มีค่าใช้จ่าย โปรดแจ้ง WERT ผ่านช่องทางในข้อ 13.1 ก่อนเวลานัดหมาย ดังนี้ (ก) งานบริการทั่วไป (เช่น งานอัดน้ำยา งานฉีดพ่น งานติดตั้ง): อย่างน้อย 48 ชั่วโมง ก่อนเวลานัด (ข) รอบติดตามผล/เติมเหยื่อของงานระบบเหยื่อ: อย่างน้อย 24 ชั่วโมง ก่อนเวลานัด (ค) ข้อผ่อนปรนเพื่อความเป็นธรรม: กรณีเหตุสุดวิสัย เหตุฉุกเฉินทางการแพทย์ หรือเหตุอื่นที่ท่านไม่อาจควบคุมได้ WERT ไม่คิดค่าใช้จ่ายใด ๆ แม้การแจ้งจะช้ากว่ากำหนดข้างต้น (ง) การแจ้งช้ากว่ากำหนดไม่ทำให้ท่านเสียสิทธิคืนเงินทั้งหมด — ผลมีเพียงการหักค่าใช้จ่ายที่เกิดขึ้นจริงตามขั้น C–E ของข้อนี้เท่านั้น
3.4 หลักฐานและการคำนวณ: ทุกกรณีที่มีการหักเงิน WERT จะแจ้งยอดคืน วิธีคำนวณ และหลักฐานค่าใช้จ่ายเป็นลายลักษณ์อักษร (เอกสารหรือช่องทางอิเล็กทรอนิกส์) ก่อนดำเนินการคืนเงิน
3.5 เงินมัดจำ: หากงานของท่านมีการวางเงินมัดจำ การริบหรือหักมัดจำจะทำได้เพียงเท่าความเสียหายที่เกิดขึ้นจริงตามหลักในข้อ 3.2 ประกอบพระราชบัญญัติว่าด้วยข้อสัญญาที่ไม่เป็นธรรม พ.ศ. 2540 มาตรา 7 — WERT ไม่ใช้นโยบาย "ริบมัดจำอัตโนมัติ"
ข้อ 4 — การเลื่อนนัดหมาย และกรณีทีมงานเข้าพื้นที่ไม่ได้ (No-show / No-access)
4.1 การเลื่อนนัดโดยลูกค้า: แจ้งผ่านช่องทางในข้อ 13.1 ได้ทุกช่องทาง หากแจ้งล่วงหน้าไม่น้อยกว่าระยะเวลาตามข้อ 3.3 การเลื่อนนัดไม่มีค่าใช้จ่าย โดยทำได้ตามสมควรโดยไม่จำกัดจำนวนครั้ง หากแจ้งช้ากว่านั้นและ WERT มีค่าใช้จ่ายเกิดขึ้นแล้วจริง ให้นำหลักการขั้น C–D ในข้อ 3 มาใช้โดยอนุโลม
4.2 การเลื่อนนัดโดย WERT: หาก WERT จำเป็นต้องเลื่อนนัด (เช่น สภาพอากาศไม่เอื้อต่อการอัดน้ำยา เหตุความปลอดภัย ทีมงานหรือวัสดุขัดข้อง) WERT จะแจ้งท่านโดยเร็วที่สุดพร้อมเสนอวันใหม่ โดยไม่มีค่าใช้จ่ายใด ๆ ต่อท่าน หาก WERT เลื่อนนัดซ้ำจนท่านไม่ประสงค์จะรับบริการต่อ ท่านมีสิทธิยกเลิกโดยได้รับเงินคืนตามขั้นตอนของงาน ณ เวลานั้น (โดยงานที่ยังไม่ได้เริ่มให้ถือเป็นขั้น A/B — คืนเต็มจำนวน)
4.3 ทีมงานไปถึงแล้วแต่เข้าให้บริการไม่ได้ (no-show / no-access): หมายถึงกรณีทีมงานไปถึงสถานที่ตามนัดแล้ว แต่ไม่มีผู้ให้เข้าพื้นที่ ติดต่อท่านไม่ได้ หรือสถานที่ไม่พร้อมจนไม่สามารถปฏิบัติงานได้ โดยไม่ได้รับแจ้งล่วงหน้า
ในกรณีดังกล่าว: (ก) ครั้งแรก: WERT จะนัดหมายใหม่ให้หนึ่งครั้งโดยไม่คิดค่าใช้จ่ายใด ๆ (ข) ครั้งถัดไป: หากเกิดเหตุการณ์เดียวกันซ้ำอีก WERT อาจคิดค่าเดินทาง/ค่าออกหน่วยเท่าต้นทุนที่เกิดขึ้นจริงและพิสูจน์ได้ด้วยหลักฐานสำหรับการออกหน่วยครั้งนั้น (เช่น ค่าเชื้อเพลิงและชั่วโมงทำงานของทีมตามบันทึกจริง) โดย WERT จะแสดงรายการคำนวณและหลักฐานให้ท่านทราบตามข้อ 3.4 ก่อนเรียกเก็บ (ค) ค่าเดินทาง/ค่าออกหน่วยคิดภายใต้ข้อ 4.3 นี้เท่านั้น และจะไม่ถูกนับซ้ำเป็นค่าใช้จ่ายตามข้อ 2.10 อีก
4.4 การนับรอบบริการกรณีเข้าพื้นที่ไม่ได้ (งานระบบเหยื่อ): สำหรับรอบติดตามผล/เติมเหยื่อของงานระบบเหยื่อ ให้ถือว่ารอบบริการรอบนั้นได้ให้บริการแล้ว เมื่อการนัดหมายสำหรับรอบนั้นซึ่งได้ประสานงานและยืนยันกันแล้ว ล้มเหลวเพราะเหตุตามข้อ 4.3 สอง (2) ครั้งติดต่อกัน ทั้งนี้ ก่อนที่ผลดังกล่าวจะเริ่มนับ WERT จะแจ้งเตือนท่านเป็นลายลักษณ์อักษรภายหลังความล้มเหลวครั้งแรก โดยระบุว่าหากการนัดหมายที่ประสานงานแล้วครั้งถัดไปล้มเหลวติดต่อกันอีกครั้ง รอบบริการนั้นจะถือว่าได้ให้บริการแล้ว หลักเกณฑ์ข้อนี้ใช้ประกอบข้อ 6.3 และเป็นหลักเกณฑ์เดียวกับที่ข้อ 8.2 ของข้อกำหนดและเงื่อนไขการใช้บริการ WERT อ้างถึง
4.5 การเข้าพื้นที่รอบติดตามผลของระบบเหยื่อ: ดูข้อ 6.3 ซึ่งใช้บังคับเพิ่มเติมสำหรับงานระบบเหยื่อ
4.6 การเลื่อนนัดไม่กระทบยอดเงินที่ชำระแล้วและไม่ก่อสิทธิคืนเงินโดยตัวมันเอง งานคงมีสถานะตามขั้นตอนในข้อ 3 ต่อไป
ข้อ 5 — การยกเลิกแพ็กเกจรายปีระหว่างอายุสัญญา
5.1 แพ็กเกจรายปี (เช่น WERT Standard / Pro / Pro Max ซึ่งประกอบด้วยการอัดน้ำยาลงดินและรอบฉีดพ่น/ติดตามผลตามที่ระบุในใบเสนอราคาและสัญญา) เป็นสัญญาบริการต่อเนื่อง ท่านมีสิทธิบอกเลิกก่อนครบกำหนดได้ตามกฎหมาย โดย WERT จะคำนวณเงินคืนอย่างเป็นธรรมจากปัจจัยต่อไปนี้: (ก) บริการที่ให้ไปแล้วจริง (งานอัดน้ำยา รอบฉีดพ่น รอบติดตามผลที่เข้าดำเนินการแล้ว) (ข) มูลค่าของบริการที่ให้แล้ว คิดตามอัตราของแพ็กเกจที่ท่านซื้อจริง (ราคาที่ชำระจริงหลังส่วนลด) — ไม่นำราคาบริการครั้งเดียว (walk-in) มาคิดย้อนหลัง (ค) วัสดุ/สารเคมีที่จัดซื้อหรือจัดเตรียมไว้เฉพาะสำหรับส่วนของบริการที่ยังไม่ได้ให้ ซึ่งเรียกคืนหรือนำไปใช้กับงานอื่นไม่ได้ (วัสดุ/สารเคมีที่ใช้ไปกับบริการที่ให้แล้ว ถือว่ารวมอยู่ในมูลค่าตาม (ข) แล้ว และจะไม่ถูกหักซ้ำ) (ง) ค่าใช้จ่ายที่เกิดขึ้นจริงตามข้อ 2.10 เฉพาะส่วนของบริการที่ยกเลิก/ยังไม่ได้ให้ (จ) ส่วนของบริการที่ยังไม่ได้ให้ ซึ่งเป็นส่วนที่ต้องคืนแก่ท่าน
5.2 WERT ไม่ใช้นโยบาย "แพ็กเกจรายปีไม่คืนเงินทุกกรณี" — ข้อสัญญาลักษณะนั้นขัดหลักความเป็นธรรมตามกฎหมายไทย และไม่ใช่แนวทางของ WERT
5.3 หลักเกณฑ์การคำนวณเงินคืน:
(ก) กติกาหลัก — สูตรถ่วงน้ำหนักตามมูลค่าองค์ประกอบของงาน: ในกรณีที่ใบเสนอราคาของท่านแสดงการแตกมูลค่าแพ็กเกจเป็นรายองค์ประกอบไว้ก่อนการขาย (เช่น งานอัดน้ำยาลงดิน = X บาท รอบฉีดพ่น/ติดตามผลครั้งละ = Y บาท รวมเท่าราคาแพ็กเกจ) เงินคืน = ราคาที่ชำระจริง − มูลค่าองค์ประกอบที่ให้บริการแล้ว − ค่าใช้จ่ายที่เกิดขึ้นจริงตามข้อ 2.10 เฉพาะส่วนของบริการที่ยังไม่ได้ให้ (ค่าใช้จ่ายของส่วนที่ให้บริการแล้วถือว่ารวมอยู่ในมูลค่าองค์ประกอบนั้นแล้ว และจะไม่ถูกหักซ้ำอีก)
(ข) เงื่อนไขบังคับของกติกาหลัก: (1) กติกาหลักใช้ได้เฉพาะเมื่อการแตกมูลค่าองค์ประกอบปรากฏในใบเสนอราคาของลูกค้ารายนั้นก่อนการขาย หรือในสัญญาบริการที่ลูกค้าลงนาม (2) มูลค่าองค์ประกอบงานรอบแรก (งานอัดน้ำยาลงดิน) ต้องไม่เกินต้นทุนตรงที่มีเอกสารรองรับ บวกส่วนเพิ่มตามสมควรที่ระบุไว้ โดย WERT จัดทำแฟ้มต้นทุนที่พร้อมแสดงเป็นหลักฐานได้ และ (3) WERT ทบทวนน้ำหนักองค์ประกอบเทียบต้นทุนจริงเป็นระยะตามสมควร
(ค) กติกาสำรองโดยอัตโนมัติ — สูตรเฉลี่ยตามรอบบริการ: หากทั้งใบเสนอราคาและสัญญาบริการที่ท่านลงนามไม่ได้แสดงการแตกมูลค่าองค์ประกอบไว้ ให้ใช้สูตรเฉลี่ยตามรอบบริการโดยอัตโนมัติ (มิใช่ทางเลือกของ WERT): เงินคืน = ราคาที่ชำระจริง × (จำนวนรอบที่ยังไม่ได้รับบริการ ÷ จำนวนรอบทั้งหมดตามสัญญา) − ค่าใช้จ่ายที่เกิดขึ้นจริงตามข้อ 2.10 เฉพาะส่วนของบริการที่ยังไม่ได้ให้
(ง) ไม่ว่ากรณีใด การคำนวณอยู่ในกรอบ "ค่าแห่งการงานส่วนที่ทำไปแล้ว" ตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 391 วรรคสาม และ WERT รับทราบว่าศาลมีอำนาจปรับลดจำนวนที่สูงเกินส่วนตามมาตรา 383 โดย WERT จะแสดงวิธีคำนวณและหลักฐานให้ท่านทราบตามข้อ 3.4 ทุกครั้ง
5.4 แพ็กเกจราคาโปรโมชั่น/ส่วนลด: การคำนวณทุกสูตรใช้ราคาที่ท่านชำระจริง ไม่ใช่ราคาเต็มก่อนส่วนลด
5.5 การบอกเลิกตามข้อนี้ให้แจ้งผ่านช่องทางในข้อ 13.1 มูลค่างานที่ให้แล้วนับถึงวันที่ WERT ได้รับแจ้ง การรับประกันที่ผูกกับแพ็กเกจสิ้นสุดตามเงื่อนไขที่ระบุในสัญญาของงานนั้นเมื่อสัญญาเลิกกัน โดยไม่กระทบสิทธิเรียกร้องเรื่องงานชำรุดบกพร่องตามกฎหมายสำหรับงานส่วนที่ทำไปแล้ว
ข้อ 6 — เงื่อนไขพิเศษ: ระบบเหยื่อกำจัดปลวก (Baiting System)
6.1 การติดตั้งสถานี = การเริ่มให้บริการ: งานระบบเหยื่อเป็นโปรแกรมต่อเนื่อง ประกอบด้วยการติดตั้งสถานีเหยื่อและรอบเข้าติดตาม/เติมเหยื่อตามจำนวนและรอบเวลาที่ระบุในใบเสนอราคาและสัญญาของงานนั้น เมื่อ WERT ติดตั้งสถานีและวางเหยื่อแล้ว ให้ถือว่าการให้บริการได้เริ่มต้นแล้ว (งานเข้าสู่ขั้น E ตามข้อ 3 ทันที)
6.2 ค่าใช้จ่ายที่หักได้ของงานระบบเหยื่อ: เหยื่อ สารเคมี และวัสดุสิ้นเปลืองที่ WERT จัดซื้อหรือจัดเตรียมไว้เฉพาะสำหรับรอบติดตาม/เติมเหยื่อที่ยังไม่ได้เข้าดำเนินการ และเรียกคืนหรือนำไปใช้กับงานอื่นไม่ได้ตามสมควร เป็นค่าใช้จ่ายที่เกิดขึ้นจริงตามข้อ 2.10 ซึ่งนำมาหักจากเงินคืนได้ ส่วนเหยื่อ วัสดุ และค่าแรงติดตั้งของงานส่วนที่ให้บริการแล้ว (เช่น การติดตั้งสถานีและการวางเหยื่อ) เป็นส่วนหนึ่งของมูลค่างานที่ให้บริการแล้วซึ่ง WERT มีสิทธิได้รับตามข้อ 6.4 และจะไม่ถูกนำมาหักซ้ำอีก
6.3 หน้าที่ให้เข้าพื้นที่รอบติดตามผล: ประสิทธิผลของระบบเหยื่อขึ้นอยู่กับการเข้าตรวจและเติมเหยื่อตามรอบต่อเนื่อง ท่านตกลงอำนวยความสะดวกให้ทีมงานเข้าพื้นที่ตามรอบนัดที่ตกลงกัน หากท่านไม่ให้เข้าพื้นที่ เลื่อนนัดซ้ำจนเกินรอบเวลาที่เหมาะสม หรือมีการเคลื่อนย้าย/เปิด/ทำลายสถานีเหยื่อโดยไม่ได้ตกลงกับ WERT ผลของโปรแกรมอาจไม่เป็นไปตามที่ออกแบบ และอาจกระทบผลการรับประกันตามเงื่อนไขที่ระบุในสัญญาของงานนั้น ทั้งนี้ ก่อนที่ผลกระทบต่อการรับประกันจะมีผล WERT จะแจ้งเตือนท่านเป็นลายลักษณ์อักษรอย่างน้อยหนึ่งครั้ง โดยระบุผลกระทบที่จะเกิดขึ้น และให้ระยะเวลาตามสมควรแก่ท่านในการนัดหมายใหม่หรือแก้ไขสถานการณ์ก่อนที่ผลนั้นจะมีผลใช้บังคับ ทั้งนี้ การนับรอบบริการกรณีเข้าพื้นที่ไม่ได้เป็นไปตามข้อ 4.4 — เมื่อการนัดหมายรอบติดตามผลที่ประสานงานและยืนยันกันแล้วล้มเหลวเพราะเหตุฝั่งท่านสอง (2) ครั้งติดต่อกัน ให้ถือว่ารอบบริการรอบนั้นได้ให้บริการแล้ว โดย WERT จะแจ้งเตือนท่านเป็นลายลักษณ์อักษรก่อนที่ผลดังกล่าวจะเริ่มนับ ตามหลักเกณฑ์ในข้อ 4.4
6.4 การยกเลิกหลังติดตั้ง: หากท่านยกเลิกโปรแกรมหลังติดตั้งสถานีแล้ว WERT จะคืนเงินเฉพาะมูลค่าส่วนของโปรแกรมที่ยังไม่ได้ให้บริการ (รอบติดตาม/เติมเหยื่อที่ยังไม่เข้าดำเนินการ ตามมูลค่าที่ระบุหรือเฉลี่ยได้จากใบเสนอราคาและสัญญา) หักค่าใช้จ่ายที่เกิดขึ้นจริงตามข้อ 6.2 ทั้งนี้ ค่าใช้จ่ายของงานส่วนที่ให้บริการแล้ว ถือว่ารวมอยู่ในมูลค่างานส่วนที่ WERT มีสิทธิได้รับไว้แล้ว และจะไม่ถูกนำมาหักซ้ำอีก โดย WERT จะแสดงรายการคำนวณและหลักฐานให้ท่านทราบตามข้อ 3.4
6.5 กรรมสิทธิ์ในสถานีเหยื่อ และการเก็บคืนเมื่อยกเลิกหรือจบโปรแกรม: สถานีเหยื่อและอุปกรณ์ที่ WERT นำมาติดตั้งเป็นทรัพย์สินของ WERT เมื่อโปรแกรมสิ้นสุดลงไม่ว่าด้วยการยกเลิกหรือการให้บริการครบถ้วน WERT จะนัดหมายเข้าเก็บสถานีและอุปกรณ์คืนโดยไม่มีค่าใช้จ่ายเพิ่มเติมต่อท่าน การเก็บคืนสถานีเป็นส่วนหนึ่งของการปิดงาน ซึ่งสอดคล้องกับหน้าที่ของผู้ประกอบการในการดูแลควบคุมวัตถุอันตรายและอุปกรณ์ที่มีสารเคมี ท่านตกลงอำนวยความสะดวกให้ WERT เข้าเก็บสถานีคืนตามนัดหมายดังกล่าว
6.6 การรับประกันของระบบเหยื่อ: ระยะเวลาและขอบเขตการรับประกัน (รวมถึงการรับประกันต่อเนื่องหลังรอบสุดท้ายตามที่ประกาศ) เป็นไปตามใบเสนอราคาและสัญญาของงานนั้น การรับประกันที่ผูกกับการจบโปรแกรมย่อมยังไม่เกิดขึ้นหากโปรแกรมถูกยกเลิกก่อนครบตามข้อ 6.4 ทั้งนี้ ไม่กระทบสิทธิเรียกร้องตามกฎหมายสำหรับงานส่วนที่ให้บริการไปแล้ว
ข้อ 7 — กรณีที่ WERT คืนเงินให้
WERT จะคืนเงินตามวิธีในข้อ 9 ในกรณีต่อไปนี้:
7.1 การชำระเงินซ้ำซ้อน: เมื่อตรวจสอบยืนยันแล้วว่ามีการชำระซ้ำสำหรับรายการเดียวกัน WERT คืนยอดที่ซ้ำเต็มจำนวนโดยเร็ว โดยไม่หักค่าใช้จ่ายใด ๆ
7.2 เรียกเก็บผิดจำนวน: หากยอดที่เรียกเก็บสูงกว่ายอดที่ตกลงตามใบเสนอราคา/สัญญา WERT คืนส่วนต่างเต็มจำนวนโดยเร็ว
7.3 WERT ไม่สามารถให้บริการได้และยังไม่ได้ส่งมอบสิ่งใด: เช่น สถานที่อยู่นอกพื้นที่ให้บริการ ไม่สามารถจัดทีม/วัสดุได้ หรือประเมินหน้างานแล้วไม่สามารถทำงานได้ตามที่ตกลง — คืนเงินเต็มจำนวนที่ได้รับไว้ ทั้งนี้ โดยปกติ WERT จะติดต่อเพื่อยืนยันนัดหมายภายใน 2 วันทำการนับแต่วันที่ได้รับชำระเงิน และหาก WERT ยังไม่สามารถยืนยันนัดหมายได้ภายใน 14 วันปฏิทินนับแต่วันที่ได้รับชำระเงิน ท่านมีสิทธิเลือกได้ทันทีระหว่างวันเข้าบริการที่แน่นอนหรือการรับเงินคืนเต็มจำนวน โดยแจ้งผ่านช่องทางในข้อ 13.1 และโดยปกติ WERT จะติดต่อท่านเพื่อเสนอทางเลือกดังกล่าวด้วย (สอดคล้องกับข้อ 4.3 ของข้อกำหนดและเงื่อนไขการใช้บริการ WERT)
7.4 ตกลงยกเลิกร่วมกัน: คืนเงินตามจำนวนและเงื่อนไขที่ตกลงกันเป็นลายลักษณ์อักษร
7.5 กรณีที่กฎหมายกำหนดให้คืน: รวมถึงการใช้สิทธิบอกเลิกสัญญาภายใน 7 วันตามข้อ 8 (พระราชบัญญัติขายตรงและตลาดแบบตรง พ.ศ. 2545) และกรณีอื่นใดที่กฎหมายกำหนดให้ WERT ต้องคืนเงิน — สิทธิเหล่านี้เป็นสิทธิตามกฎหมายที่ไม่ถูกตัดโดยนโยบายนี้
7.6 กรณีอื่นที่ WERT อนุมัติ: WERT อาจคืนเงินเป็นกรณีพิเศษด้วยเหตุผลด้านการดูแลลูกค้า การอนุมัติเป็นรายกรณีไม่ถือเป็นแนวปฏิบัติผูกพันสำหรับกรณีอื่น
ข้อ 8 — สิทธิบอกเลิกสัญญาภายใน 7 วัน สำหรับการซื้อภายใต้กฎหมายขายตรงและตลาดแบบตรง
8.1 กรณีการซื้อบริการของท่านอยู่ภายใต้บังคับพระราชบัญญัติขายตรงและตลาดแบบตรง พ.ศ. 2545 (เช่น การสั่งซื้อและชำระเงินผ่านช่องทางออนไลน์เมื่อเปิดให้บริการ รวมถึงการชำระผ่านลิงก์ชำระเงินรายบุคคล หากกฎหมายดังกล่าวใช้บังคับกับการซื้อนั้น) ท่านมีสิทธิบอกเลิกสัญญาโดยแจ้งเป็นหนังสือภายใน 7 วันนับแต่วันที่ได้รับบริการ ตามมาตรา 33 แห่งพระราชบัญญัติดังกล่าว สิทธินี้เป็นสิทธิตามกฎหมายที่นโยบายนี้ไม่ตัด ไม่จำกัด และไม่กำหนดเงื่อนไขเพิ่มเติมใด ๆ
8.2 วิธีใช้สิทธิ: แจ้งความประสงค์บอกเลิกเป็นหนังสือหรือข้อความลายลักษณ์อักษรผ่านช่องทางในข้อ 13.1 (แนะนำอีเมล contact@wert.in.th หรือ LINE Official: @WERT เพื่อความชัดเจนของวันที่แจ้ง) พร้อมระบุชื่อของท่าน เลขที่รายการ/ใบเสร็จ และวันที่ชำระเงิน วันที่ WERT ได้รับหนังสือบอกเลิกเป็นวันเริ่มนับกำหนดเวลาคืนเงิน
8.3 กำหนดคืนเงิน: WERT จะคืนเงินภายใน 15 วันนับแต่วันที่ได้รับหนังสือบอกเลิก ตามมาตรา 36 แห่งพระราชบัญญัติดังกล่าว
8.4 ความสัมพันธ์กับข้อ 3: การหักเงินตามขั้นตอน A–F ในข้อ 3 ไม่ใช้บังคับกับการบอกเลิกโดยชอบตามข้อนี้ เว้นแต่การหักกลบลบหนี้เท่าที่กฎหมายอนุญาตให้ทำได้
ข้อ 9 — วิธีการคืนเงิน
9.1 คืนผ่านช่องทางเดิมที่ชำระ (เท่าที่ทำได้): (ก) ชำระด้วยบัตร → คืนเข้าบัตรใบเดิมที่ใช้ชำระเท่านั้น ผ่านผู้ให้บริการรับชำระเงิน/เครือข่ายบัตร (ไม่คืนรายการบัตรเป็นเงินสดหรือโอน เพราะขัดกติกาเครือข่ายบัตรและมาตรฐานป้องกันการฟอกเงิน) การคืนเงินเข้าบัตรจะส่งไปยังบัตรใบเดิมเสมอแม้บัตรนั้นจะถูกปิดหรือเปลี่ยนบัตรแล้ว โดยปกติธนาคารผู้ออกบัตรจะจัดการโอนเงินต่อไปยังบัตรหรือบัญชีใหม่ของท่าน หากมีข้อขัดข้อง ให้ดำเนินการตามข้อ 9.1(ง) (ข) ชำระด้วยการโอนผ่านธนาคาร → คืนเข้าบัญชีต้นทางที่โอนมา โดยตรวจสอบชื่อบัญชีให้ตรงกับผู้ชำระ (ค) ชำระเงินสด → คืนโดยโอนเข้าบัญชีธนาคารในชื่อของผู้ชำระ พร้อมการยืนยันตัวตนและการลงนามรับเงินคืนไว้เป็นหลักฐาน (ง) สำหรับการชำระด้วยการโอนหรือเงินสด: หากบัญชีเดิมใช้ไม่ได้แล้วจริง (เช่น บัญชีถูกปิด) WERT จะคืนเข้าบัญชีอื่นในชื่อบุคคลเดียวกันที่ยืนยันตัวตนแล้ว โดยบันทึกเหตุผลไว้เป็นหลักฐาน สำหรับการชำระด้วยบัตร: WERT จะคืนเงินโดยโอนเข้าบัญชีที่ยืนยันตัวตนแล้วในชื่อผู้ถือบัตรได้ เฉพาะเมื่อผู้ให้บริการรับชำระเงินยืนยันเป็นลายลักษณ์อักษรว่าไม่สามารถประมวลผลการคืนเงินเข้าบัตรใบเดิมได้อีกต่อไป (เช่น พ้นกรอบเวลาการคืนเงินของรายการเดิม) โดย WERT เก็บหนังสือยืนยันนั้นไว้เป็นหลักฐาน
9.2 ความรับผิดชอบของ WERT จำกัดที่ยอดเงินบาท: WERT รับผิดชอบการคืนเงินตามจำนวน เงินบาท (THB) ที่อนุมัติเต็มจำนวน โดยไม่หักค่าธรรมเนียมการชำระเงินออกจากยอดที่อนุมัติ ส่วนต่างจากอัตราแลกเปลี่ยนและค่าธรรมเนียมของธนาคารผู้ออกบัตรเป็นเรื่องระหว่างท่านกับผู้ออกบัตรของท่านตามข้อ 10
9.3 กำหนดเวลา: เมื่อการคืนเงินได้รับอนุมัติ WERT จะส่งคำสั่งคืนเงินไปยังธนาคารหรือผู้ให้บริการรับชำระเงินภายในกำหนดเวลาตามข้อ 13.3 หลังจากส่งคำสั่งแล้ว ระยะเวลาที่เงินเข้าถึงท่านขึ้นอยู่กับผู้ให้บริการรับชำระเงิน เครือข่ายบัตร และธนาคารผู้ออกบัตรของท่าน ซึ่งอยู่นอกเหนือการควบคุมของ WERT (โดยทั่วไปรายการบัตรใช้เวลาประมาณ 5–10 วันทำการจึงปรากฏในบัญชีบัตร — เป็นข้อมูลทั่วไป มิใช่คำรับรอง) WERT จะส่งหลักฐานอ้างอิงการคืนเงิน (เช่น เลขอ้างอิงรายการ) ให้ท่านเมื่อร้องขอ
9.4 กรณีที่กฎหมายกำหนดเวลาคืนเงินไว้เป็นการเฉพาะ (เช่น 15 วันตามข้อ 8) ให้ถือกำหนดเวลาตามกฎหมายนั้น
ข้อ 10 — บัตรที่ออกในต่างประเทศ และการแปลงสกุลเงิน
10.1 WERT กำหนดราคาและเรียกเก็บเป็น เงินบาทไทย (THB) เท่านั้น และไม่ให้บริการแปลงสกุลเงิน ณ จุดขาย (ไม่มี Dynamic Currency Conversion) ยอดในสกุลเงินของท่านที่ปรากฏในใบแจ้งยอดบัตร เกิดจากการแปลงโดยเครือข่ายบัตรและธนาคารผู้ออกบัตรของท่าน ตามอัตราและนโยบายของผู้ออกบัตร ซึ่งอาจรวมค่าธรรมเนียมการใช้บัตรในต่างประเทศ (foreign transaction fee) และค่าธรรมเนียมการแปลงสกุลเงินตามที่ผู้ออกบัตรกำหนด
10.2 การคืนเงินรายการบัตรจะคืนเป็น THB ตามยอดที่อนุมัติ เข้าบัตรใบเดิม ธนาคารผู้ออกบัตรของท่านจะแปลงเป็นสกุลเงินของท่านด้วยอัตราแลกเปลี่ยน ณ วันที่ประมวลผลการคืนเงิน ซึ่งอาจไม่ใช่อัตราเดียวกับวันที่ชำระ ดังนั้นยอดที่ท่านได้รับคืนในสกุลเงินของท่านอาจมากกว่าหรือน้อยกว่ายอดที่ถูกเรียกเก็บครั้งแรก และค่าธรรมเนียมของผู้ออกบัตรอาจไม่ได้รับคืนตามนโยบายของผู้ออกบัตรเอง — ส่วนต่างเหล่านี้ไม่ใช่ความบกพร่องของการคืนเงิน และไม่อยู่ในความรับผิดชอบของ WERT
10.3 ตัวอย่างประกอบ (ตัวเลขสมมติทั้งหมด เพื่ออธิบายเท่านั้น): ท่านชำระค่าบริการ 20,000 บาท ด้วยบัตรที่ออกในสหรัฐอเมริกา • วันชำระ สมมติอัตรา 36.00 บาท/ดอลลาร์สหรัฐ → ผู้ออกบัตรเรียกเก็บประมาณ 555.56 ดอลลาร์ และอาจบวกค่าธรรมเนียมการใช้บัตรต่างประเทศ (เช่น หากผู้ออกบัตรคิด 2% จะประมาณ 11.11 ดอลลาร์) รวมประมาณ 566.67 ดอลลาร์ • ต่อมา WERT คืนเงินเต็มจำนวน 20,000 บาท — หากวันประมวลผลคืนเงินอัตราอยู่ที่ 37.00 บาท/ดอลลาร์ ท่านจะได้รับคืนประมาณ 540.54 ดอลลาร์ แต่หากอัตราอยู่ที่ 35.00 บาท/ดอลลาร์ ท่านจะได้รับคืนประมาณ 571.43 ดอลลาร์ • ค่าธรรมเนียมที่ผู้ออกบัตรเคยเรียกเก็บ อาจคืนหรือไม่คืนตามนโยบายของผู้ออกบัตรเอง ในทุกกรณี WERT ได้คืนเงินครบถ้วนแล้วเมื่อคืนยอด 20,000 บาท (ยอด THB ที่อนุมัติ) เต็มจำนวน
10.4 หากท่านมีข้อสงสัยเกี่ยวกับอัตราแลกเปลี่ยนหรือค่าธรรมเนียมของบัตร โปรดติดต่อธนาคารผู้ออกบัตรของท่าน ซึ่งเป็นผู้กำหนดอัตราและนโยบายดังกล่าวแต่ผู้เดียว
ข้อ 11 — ข้อโต้แย้งการชำระเงิน และการปฏิเสธรายการผ่านผู้ออกบัตร (Chargeback)
11.1 ติดต่อ WERT ก่อน: หากท่านเห็นรายการเรียกเก็บที่ไม่ถูกต้อง ไม่รู้จัก หรือไม่พอใจในบริการ ท่านตกลงที่จะติดต่อ WERT ตามช่องทางในข้อ 13.1 และให้เวลา WERT 7 วัน ในการตรวจสอบและแก้ไข ก่อนยื่นข้อโต้แย้งรายการต่อธนาคารหรือผู้ออกบัตรของท่าน ทั้งนี้ ข้อตกลงนี้ไม่จำกัดสิทธิตามกฎหมายของท่านหรือสิทธิตามกติกาของเครือข่ายบัตรแต่อย่างใด (ดูข้อ 11.2) ปัญหาส่วนใหญ่ (ยอดผิด รายการซ้ำ จำชื่อร้านค้าบนใบแจ้งยอดไม่ได้ งานมีข้อบกพร่อง) ตรวจสอบและแก้ไขได้เร็วกว่ากระบวนการของธนาคารมาก
11.2 สิทธิของท่านคงอยู่: ข้อตกลงให้ติดต่อ WERT ก่อนตามข้อ 11.1 มีไว้เพื่อความรวดเร็วในการแก้ปัญหาเท่านั้น ไม่มีข้อความใดในนโยบายนี้ตัดหรือจำกัดสิทธิของท่านตามกฎหมาย หรือสิทธิในการโต้แย้งรายการผ่านธนาคารผู้ออกบัตรตามกติกาของเครือข่ายบัตร
11.3 การปฏิเสธรายการไม่ใช่การคืนเงินจาก WERT: Chargeback เป็นกระบวนการระหว่างธนาคารผู้ออกบัตร เครือข่ายบัตร และผู้ให้บริการรับชำระเงิน ซึ่งมีขั้นตอนและกรอบเวลาของตัวเอง การยื่น chargeback ระหว่างที่ WERT กำลังดำเนินการคืนเงินอยู่แล้ว อาจทำให้การได้รับเงินคืนช้าลง หาก WERT คืนเงินแล้ว ท่านจะได้รับหลักฐานอ้างอิงเพื่อแจ้งธนาคารของท่านได้ทันที ทั้งนี้ เมื่อมีการยื่นปฏิเสธรายการต่อผู้ออกบัตรแล้ว WERT จำเป็นต้องระงับการคืนเงินที่อยู่ระหว่างดำเนินการไว้ และชี้แจงผ่านกระบวนการข้อโต้แย้งของเครือข่ายบัตรแทน โดยผลลัพธ์จะเป็นไปตามกระบวนการดังกล่าว
11.4 สิทธิของ WERT ในการชี้แจงพร้อมพยานหลักฐาน: เมื่อมีการยื่นปฏิเสธรายการ WERT มีสิทธิชี้แจงข้อเท็จจริงต่อธนาคารและเครือข่ายบัตรผ่านผู้ให้บริการรับชำระเงิน พร้อมส่งพยานหลักฐานที่เกี่ยวข้องเท่าที่กฎหมายอนุญาต ซึ่งอาจรวมถึง: ใบเสนอราคา ใบแจ้งหนี้/ใบเสร็จรับเงิน หลักฐานยืนยันการชำระเงิน หมายเลขไอพี (IP address) และข้อมูลอุปกรณ์ขณะทำรายการหรือยอมรับเงื่อนไข เวลาประทับและเวอร์ชันของข้อกำหนดที่กดยอมรับ ที่อยู่สถานที่รับบริการ บันทึกนัดหมายและการยืนยันนัด ข้อความสนทนา (เช่น LINE/อีเมล) ภาพถ่ายหน้างาน รายงานการให้บริการ หลักฐานการเข้าพื้นที่รวมถึงข้อมูลตำแหน่ง (GPS) เท่าที่กฎหมายอนุญาต ลายมือชื่อและเอกสารส่งมอบงาน ภาพถ่ายก่อน–หลังการให้บริการ และบันทึกรอบติดตามผล — การเก็บและใช้ข้อมูลเหล่านี้เป็นไปตามนโยบายความเป็นส่วนตัวของ WERT (ฐานการปฏิบัติตามสัญญาและประโยชน์อันชอบธรรมในการก่อตั้งและต่อสู้สิทธิเรียกร้องตามกฎหมาย)
11.5 กรณีอ้างว่าไม่รู้จักรายการทั้งที่รับบริการแล้ว: หากปรากฏหลักฐานว่ามีการสั่งซื้อ รับบริการ และยืนยันความเรียบร้อยของงานแล้ว แต่ต่อมามีการปฏิเสธรายการโดยอ้างว่าไม่รู้จักหรือไม่ได้อนุญาต WERT จะใช้สิทธิชี้แจงและต่อสู้ข้อโต้แย้งนั้นด้วยพยานหลักฐานตามข้อ 11.4 อย่างเต็มที่ และเฉพาะในกรณีการปฏิเสธรายการโดยทุจริตหรือโดยรู้อยู่ว่ารายการถูกต้อง ซึ่งก่อความเสียหายแก่ WERT นั้น WERT สงวนสิทธิเรียกร้องค่าเสียหายที่เกิดขึ้นจริงตามที่กฎหมายไทยให้อำนาจ ผ่านกระบวนการตามกฎหมายเท่านั้น — WERT ไม่กำหนด "ค่าปรับ chargeback" เหมาจ่ายใด ๆ ต่อลูกค้า
11.6 WERT ปฏิบัติต่อข้อโต้แย้งทุกรายการอย่างมืออาชีพและปราศจากอคติ และจะคืนเงินทันทีที่ข้อเท็จจริงปรากฏว่าท่านมีสิทธิได้รับคืนตามนโยบายนี้หรือตามกฎหมาย
ข้อ 12 — รายการที่ไม่ได้รับอนุญาตหรือเกิดจากการทุจริต
12.1 หากท่านพบรายการเรียกเก็บจาก WERT ที่ท่านไม่ได้ทำรายการเอง (เช่น บัตรหรือบัญชีถูกใช้โดยผู้อื่น): (ก) แจ้งธนาคารหรือผู้ออกบัตรของท่านทันทีเพื่ออายัดหรือระงับบัตร และ (ข) แจ้ง WERT ตามช่องทางในข้อ 13.1 พร้อมข้อมูลรายการเท่าที่ท่านมี เพื่อให้ WERT ตรวจสอบและระงับการให้บริการที่เกี่ยวข้องไว้ก่อน
12.2 แนวปฏิบัติของ WERT ต่อผู้เสียหายจากการทุจริต: WERT จะตรวจสอบโดยเร็ว ระงับงานที่ยังไม่ได้ให้บริการ ให้ความร่วมมือเต็มที่กับธนาคารผู้ออกบัตร ผู้ให้บริการรับชำระเงิน และพนักงานเจ้าหน้าที่ และหากตรวจสอบยืนยันได้ว่ารายการเกิดจากการทุจริตและยังไม่มีการให้บริการ WERT จะดำเนินการคืนเงิน/ยกเลิกรายการฝั่ง WERT โดยไม่รอผลกระบวนการอื่น ท่านสามารถแจ้งความต่อพนักงานสอบสวน และใช้ช่องทางศูนย์ปฏิบัติการแก้ไขปัญหาอาชญากรรมออนไลน์ (สายด่วน AOC 1441) ได้อีกทางหนึ่ง
12.3 มาตรการฝั่ง WERT: เพื่อป้องกันการทุจริต WERT สงวนสิทธิตรวจสอบยืนยันตัวตนหรือการอนุญาตใช้บัตรสำหรับรายการที่มีลักษณะผิดปกติ ชะลอการเริ่มงานระหว่างตรวจสอบ และคืนเงินพร้อมปฏิเสธการรับงานสำหรับรายการที่เชื่อได้ว่าไม่ชอบด้วยกฎหมาย โดยจะแจ้งให้ผู้ชำระเงินทราบ
ข้อ 13 — วิธีขอคืนเงิน
13.1 ช่องทางแจ้ง: LINE Official: @WERT · อีเมล contact@wert.in.th · โทร 081-968-2294 (ทุกช่องทางถือว่าใช้ได้เท่ากัน — แนะนำช่องทางที่เป็นลายลักษณ์อักษรเพื่อความชัดเจนของวันที่แจ้ง)
13.2 ข้อมูลที่ควรแจ้ง: ชื่อ–นามสกุลและเบอร์ติดต่อ · เลขที่ใบเสนอราคา/สัญญา/ใบเสร็จ (ถ้ามี) · วันที่และจำนวนเงินที่ชำระ · ช่องทางที่ชำระพร้อมหลักฐาน (เช่น สลิปโอน, สี่หลักท้ายของบัตร — ห้ามส่งหมายเลขบัตรเต็มหรือรหัส CVV) · เหตุผลที่ขอคืน · สำหรับการโอน: บัญชีปลายทางเดิมสำหรับรับเงินคืน

13.4 ผลการพิจารณา: WERT แจ้งผลเป็นลายลักษณ์อักษร หากมีการหักค่าใช้จ่าย จะแนบรายการและหลักฐานตามข้อ 3.4 หากปฏิเสธ จะแจ้งเหตุผลและข้อสัญญา/ข้อกฎหมายที่อ้างอิง
13.5 หากไม่เห็นด้วยกับผล: ท่านขอให้ทบทวนอีกครั้งได้โดยแจ้งเหตุผลเพิ่มเติม ทั้งนี้ ไม่กระทบสิทธิของท่านในการร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองผู้บริโภค (สายด่วน สคบ. 1166) การใช้สิทธิทางศาลตามพระราชบัญญัติวิธีพิจารณาคดีผู้บริโภค พ.ศ. 2551 หรือสิทธิในการโต้แย้งรายการผ่านผู้ออกบัตรของท่าน
ข้อ 14 — เวอร์ชันของนโยบาย และเวอร์ชันที่ใช้บังคับ
14.1 นโยบายนี้ระบุหมายเลขเวอร์ชันและวันที่มีผลใช้บังคับไว้ที่ส่วนหัวเสมอ WERT เก็บรักษานโยบายทุกเวอร์ชันย้อนหลัง และท่านขอสำเนาเวอร์ชันก่อนหน้าได้ตามช่องทางในข้อ 13.1
14.2 เวอร์ชันที่ใช้บังคับกับรายการของท่าน คือเวอร์ชันที่มีผลอยู่ ณ เวลาที่ท่านชำระเงินสำหรับรายการนั้น การแก้ไขนโยบายภายหลังไม่ใช้ย้อนหลังกับรายการที่ชำระแล้ว เว้นแต่การแก้ไขนั้นให้สิทธิแก่ท่านมากขึ้น
14.3 เมื่อ WERT เปิดรับชำระเงินออนไลน์ ระบบจะแสดงนโยบายนี้ (หรือสรุปพร้อมลิงก์) ณ ขั้นตอนชำระเงินก่อนยืนยันรายการ และบันทึกเวอร์ชันของนโยบาย วันเวลา และการกดยอมรับของท่านไว้เป็นหลักฐานประกอบรายการ ทั้งนี้ ให้ใช้บังคับเช่นเดียวกันกับการชำระผ่านลิงก์ชำระเงินที่ WERT ส่งให้เป็นรายบุคคล ซึ่งจะเปิดหน้ายืนยันการชำระเงินของ WERT ก่อนเข้าสู่ขั้นตอนชำระเงินเสมอ
14.4 การแก้ไขที่เป็นสาระสำคัญจะประกาศบนเว็บไซต์ wert.in.th พร้อมวันที่มีผล สำหรับการแก้ไขที่กระทบสัญญาที่ยังอยู่ระหว่างอายุสัญญา WERT จะประกาศล่วงหน้าอย่างน้อย 30 วันก่อนวันที่มีผล และการแก้ไขที่ลดสิทธิของท่านจะไม่ใช้บังคับกับสัญญานั้นจนกว่าจะมีการต่ออายุครั้งถัดไป

Section 1 — Scope of this Policy and Relationship to the WERT Terms & Conditions of Service
1.1 This Policy applies to every service WERT provides (including liquid-injection termite treatment, pipe-based termite treatment systems, the termite baiting system, general pest control, and commercial-premises services) within our service areas of Chonburi and Rayong provinces, however you place your order (LINE, telephone, in person, the website, or any online channel once available).
1.2 This Policy forms part of the WERT Terms & Conditions of Service. On the subjects of cancellation, rescheduling, refunds, and payment disputes, this Policy is the specific document and takes precedence.
1.3 The quotation and service contract for a particular job may set job-specific details (such as the number of service visits, warranty period, and covered area). Those documents are to be read together with this Policy; where they differ on job-specific figures or scope, the job documents prevail, unless that would leave you with less protection than the law requires. For consumers, a job-specific document may reduce a protection stated in this published Policy only where the difference is specifically highlighted, separately signed or accepted, and justified by the nature of that job; otherwise this published Policy prevails.
1.4 Nothing in this Policy is intended to limit or exclude any right you have under law, including the Civil and Commercial Code, the Consumer Protection Act B.E. 2522 (1979), the Unfair Contract Terms Act B.E. 2540 (1997), and — where it applies — the Direct Sales and Direct Marketing Act B.E. 2545 (2002). If any provision conflicts with mandatory law, it is ineffective only to the extent of the conflict, and the remainder of this Policy continues in force.
1.5 This Policy is issued in Thai and in English with identical substance. To the extent permitted by applicable law, the Thai version prevails in the event of any difference in interpretation.
Section 2 — Definitions and the Eight Distinct Payment Matters
To resolve matters quickly and through the right channel, WERT distinguishes eight types of payment-related matters, each with its own process and legal consequences:
2.1 WERT-approved Refund — WERT agrees to return all or part of your payment under this Policy, your contract, or the law, through the original payment channel (Section 9).
2.2 Customer Cancellation — you cancel all or part of a service you have ordered. The outcome depends on the stage the work has reached when you notify us (Section 3).
2.3 Rescheduling — changing the service date or time while the job itself continues. It is not a cancellation and, as a rule, involves no refund (Section 4).
2.4 Payment Dispute — you notify WERT directly that a charge, amount, or payment record is incorrect, so that WERT can investigate and put it right (Sections 11 and 13).
2.5 Chargeback through your card issuer — the process by which you exercise rights through your bank or card issuer under the card networks' rules (e.g., Visa, Mastercard). It is a separate track from requesting a refund from WERT (Section 11).
2.6 Unauthorized / Fraudulent Transaction — a payment made without the authorization of the cardholder or account holder, such as where a card is stolen or card details are compromised (Section 12).
2.7 Duplicate Payment — more than one payment for the same item, such as a repeated transfer or a card charged twice (Section 7.1).
2.8 WERT Unable to Provide Service — WERT itself cannot deliver the agreed service, for example because the property is outside our service area or we cannot field a crew (Section 7.3).
2.9 Payment status is not appointment status. "Payment received" means only that WERT has received your money. It does not mean "service appointment confirmed." An appointment is confirmed only when WERT expressly confirms the service date and time to you (for example via LINE, an appointment document, or the WERT member system). Wherever this Policy refers to "appointment confirmation," time runs from that express confirmation.
2.10 "Actual costs" in this Policy means costs that (a) have genuinely been incurred specifically for your job, (b) WERT can prove with evidence such as receipts, purchase orders, or materials-issue records, (c) cannot reasonably be recovered or redeployed to other work, and (d) are attributable solely to the cancelled or undelivered portion of the services. Costs of work already delivered are treated as included in the value of the delivered work that WERT is entitled to retain, and are never deducted a second time. Whenever any cost is deducted from a refund, WERT will provide you with an itemized statement and the supporting evidence.
Section 3 — Service Stages (A–F) and the Effect of Customer Cancellation at Each Stage
The Direct Sales and Direct Marketing Act takes precedence over this Section: for purchases within the scope of the Direct Sales and Direct Marketing Act B.E. 2545 (2002) (for example, orders placed and paid online, where that Act applies to the purchase), cancellation within 7 days of receiving the service follows Section 8 — a full refund within 15 days — and the stage deductions in this Section do not apply, except for any set-off the law permits.
3.1 Stage table

Table note: this table is subject to Section 8 — a lawful cancellation within 7 days under the Direct Sales and Direct Marketing Act B.E. 2545 receives a full refund within 15 days, without the Stage C–F deductions, except for any set-off the law permits.
3.2 Rules by stage
(a) Stage A — before the service date is confirmed: you may cancel at any time. WERT refunds everything received, with no deduction whatsoever.
(b) Stage B — appointment confirmed, no preparations yet: you may cancel, and WERT refunds in full. Giving notice within the advance-notice window in Section 3.3 is the best way to ensure your job is still at Stage B (no costs yet incurred).
(c) Stage C — genuine preparation costs incurred: WERT refunds after deducting only actual, provable, unrecoverable costs as defined in Section 2.10. The burden of producing evidence of those costs rests on WERT.
(d) Stage D — crew already en route: in addition to the costs under (c), WERT may charge a travel/call-out fee at a reasonable rate consistent with the loss actually suffered (under the rules in Section 4.3). WERT acknowledges that a court may reduce any excessive agreed charge under Section 383 of the Civil and Commercial Code, and intends to set the rate close to true cost from the outset. Travel and dispatch costs are charged only under this call-out head and are never also counted as costs under Section 2.10.
(e) Stage E — service begun: even after service has begun, you retain your statutory right to terminate the remaining work (Civil and Commercial Code, Section 605), while WERT is entitled to the value of the work already performed (Section 391 paragraph 3). The value of work performed is calculated at the rate of the package/contract you actually bought — not re-priced retrospectively at single-visit rates. For annual packages see Section 5; for the baiting system see Section 6. The only deductible costs are Section 2.10 costs attributable to the cancelled/undelivered portion — costs of the work already delivered are treated as included in the value of the delivered work WERT is entitled to retain, and are never deducted a second time.
(f) Stage F — work fully completed: there is no cancellation or refund for change of mind after completion. However, the following remain fully intact: (1) your statutory claims for defective work, (2) your rights under the warranty stated in the quotation/contract for that job, and (3) any statutory termination right that applies (see Section 8). If there is a problem with the work, please contact WERT first so we can inspect and remedy it under the warranty terms.
3.3 Minimum advance notice for cancellation/rescheduling. To cancel or reschedule free of charge, please notify WERT through the channels in Section 13.1 before the appointment time, as follows: (a) general service visits (such as soil injection, spraying, or installation work): at least 48 hours before the appointment time; (b) follow-up/refill visits under the baiting system: at least 24 hours before the appointment time; (c) Fairness carve-out: in cases of force majeure, medical emergency, or other events beyond your control, WERT charges nothing even where notice is shorter than the above; (d) late notice never forfeits your refund as a whole — its only effect is the deduction of actual costs under Stages C–E of this Section.
3.4 Evidence and calculation: whenever any amount is deducted, WERT will state the refund amount, the calculation method, and the cost evidence in writing (on paper or electronically) before processing the refund.
3.5 Deposits: where your job involves a deposit, any forfeiture or deduction from the deposit is limited to the loss actually suffered, applying the principles of Section 3.2 together with Section 7 of the Unfair Contract Terms Act B.E. 2540. WERT does not operate an "automatic deposit forfeiture" policy.
Section 4 — Rescheduling, and Cases Where the Crew Cannot Gain Access (No-show / No-access)
4.1 Rescheduling by the customer: notify us through any channel in Section 13.1. If you give at least the advance notice set under Section 3.3, rescheduling is free of charge and may be done within reason, without a fixed limit on the number of times. If notice is shorter and WERT has already genuinely incurred costs, the principles of Stages C–D in Section 3 apply with the necessary changes.
4.2 Rescheduling by WERT: if WERT must reschedule (for example, weather unsuitable for soil injection, safety concerns, or crew/materials disruption), WERT will notify you as early as possible and propose a new date, at no cost to you. If repeated rescheduling by WERT leads you to no longer want the service, you may cancel and receive a refund according to the stage the job has reached (work not yet begun is treated as Stage A/B — refunded in full).
4.3 Crew arrived but could not perform the service (no-show / no-access): this covers cases where the crew arrives at the agreed time, but no one provides access, you cannot be reached, or the premises are not in a workable condition — without prior notice to us.
In such cases: (a) First incident: WERT will re-book one new appointment at no charge. (b) Subsequent incidents: if the same situation recurs, WERT may charge a travel/call-out fee equal to the actual, documented cost of that dispatch (such as fuel and crew working hours taken from actual records), and will provide you with the itemized calculation and evidence required by Section 3.4 before charging. (c) Travel/call-out costs are charged only under this Section 4.3 and are never also counted as costs under Section 2.10.
4.4 Counting of service rounds on no-access (baiting-system jobs). For follow-up/refill visits under the baiting system, a service round is treated as delivered once the coordinated and confirmed appointments for that round have failed for the reasons described in Section 4.3 two (2) consecutive times. Before that rule starts to count, WERT will warn you in writing after the first failed appointment, stating that if the next coordinated appointment also fails consecutively, that service round will be treated as delivered. This rule applies together with Section 6.3 and is the rule referred to by Section 8.2 of the WERT Terms & Conditions of Service.
4.5 Access for baiting-system follow-up visits: Section 6.3 applies additionally to baiting-system jobs.
4.6 Rescheduling does not affect amounts already paid and does not of itself create a refund entitlement; the job simply continues at its stage under Section 3.
Section 5 — Mid-term Cancellation of Annual Service Packages
5.1 Annual packages (such as WERT Standard / Pro / Pro Max, comprising soil injection and the spray/follow-up visits stated in your quotation and contract) are continuing service contracts. You may terminate before the end of the term as the law allows, and WERT will calculate your refund fairly from the following factors: (a) services actually rendered (the injection work and any spray/follow-up visits already performed); (b) the value of services rendered, priced at the rate of the package you actually bought (the price actually paid, after discounts) — never re-priced retrospectively at single-visit walk-in rates; (c) materials/chemicals purchased or prepared specifically for the undelivered portion of the services that cannot be recovered or redeployed (materials/chemicals already consumed on services delivered are treated as included in the value under (b) and are not deducted again); (d) actual costs as defined in Section 2.10 attributable to the cancelled/undelivered portion only; and (e) the undelivered portion of the services, which is the portion to be refunded to you.
5.2 WERT does not operate a "no refunds on annual packages under any circumstances" policy — a term of that kind is inconsistent with fairness principles under Thai law and is not WERT's approach.
5.3 Refund calculation rules:
(a) Primary rule — component-weighted formula: where your quotation breaks the package price into component values before the sale (for example, soil-injection work = THB X; each spray/follow-up visit = THB Y; totalling the package price), Refund = price actually paid − value of components already delivered − actual costs under Section 2.10 attributable to the undelivered portion only (costs of delivered components are treated as included in those components' value and are never deducted again).
(b) Mandatory conditions of the primary rule: (1) the primary rule applies only where the component-value breakdown appeared in your own quotation before the sale or in the service contract you signed; (2) the first-visit component (the soil-injection work) must not exceed documented direct cost plus a stated reasonable margin, supported by a cost file WERT keeps ready to produce as evidence; and (3) WERT reviews the component weights against actual costs periodically.
(c) Automatic fallback rule — per-visit average formula: where neither your quotation nor the service contract you signed shows a component-value breakdown, the per-visit average formula applies automatically (not at WERT's option): Refund = price actually paid × (visits not yet received ÷ total contracted visits) − actual costs under Section 2.10 attributable to the undelivered portion only.
(d) In every case, the calculation remains within the frame of "the value of the work already performed" under Section 391 paragraph 3 of the Civil and Commercial Code, and WERT acknowledges that a court may reduce any excessive amount under Section 383. WERT will show you the calculation method and evidence in accordance with Section 3.4 in every case.
5.4 Promotional/discounted packages: every formula uses the price you actually paid, not the undiscounted list price.
5.5 Notice of termination under this Section may be given through any channel in Section 13.1. The value of work delivered is measured up to the date WERT receives your notice. Any warranty attached to the package ends in accordance with the contract terms for that job upon termination, without affecting your statutory claims for defects in the work already performed.
Section 6 — Special Terms: Termite Baiting System
6.1 Station installation is commencement of service. A baiting-system job is a continuing program consisting of installing bait stations and follow-up/refill visits in the number and cadence stated in the quotation and contract for that job. Once WERT has installed the stations and placed bait, service has commenced (the job immediately enters Stage E under Section 3).
6.2 Deductible costs on baiting-system jobs. Bait, chemicals, and consumables that WERT has purchased or prepared specifically for follow-up/refill visits not yet performed, and that cannot reasonably be recovered or redeployed, are actual costs under Section 2.10 and may be deducted from any refund. Bait, materials, and installation labor for the portion of the work already delivered (such as installing the stations and placing bait) form part of the value of the delivered work that WERT is entitled to retain under Section 6.4, and are never deducted a second time.
6.3 Duty to allow access for follow-up visits. The baiting system's effectiveness depends on continuous scheduled inspection and refilling. You agree to give the crew access at the agreed follow-up times. If access is refused, appointments are repeatedly postponed beyond a reasonable interval, or stations are moved, opened, or destroyed without WERT's agreement, the program may not perform as designed and warranty outcomes may be affected in accordance with the contract terms for that job. Before any warranty consequence takes effect, WERT will give you at least one written warning identifying the consequence, together with a reasonable period to re-book or remedy the situation before that consequence applies. The counting of service rounds on no-access follows Section 4.4 — once two (2) consecutive coordinated and confirmed follow-up appointments fail for reasons on your side, that service round is treated as delivered, with WERT warning you in writing before that rule starts to count, as set out in Section 4.4.
6.4 Cancellation after installation. If you cancel the program after stations are installed, WERT will refund only the value of the undelivered portion of the program (follow-up/refill visits not yet performed, at the values stated in — or fairly averaged from — the quotation and contract), less actual costs under Section 6.2. Costs of the work already delivered are treated as included in the value of the delivered work WERT is entitled to retain, and are never deducted a second time. WERT will provide the itemized calculation and evidence required by Section 3.4.
6.5 Ownership of bait stations, and collection on cancellation or completion. Bait stations and equipment installed by WERT remain WERT's property. When the program ends — whether by cancellation or on completion of service — WERT will schedule a visit to collect the stations and equipment at no extra charge to you. Station collection is part of job close-out, consistent with an operator's duty of care over hazardous substances and chemical-bearing equipment. You agree to give WERT access for that collection visit.
6.6 Baiting-system warranty. The warranty period and scope (including any continued warranty after the final visit, as published) are as stated in the quotation and contract for that job. A warranty conditioned on completing the program does not arise where the program is cancelled before completion under Section 6.4. This does not affect your statutory claims in respect of the services already delivered.
Section 7 — Cases in Which WERT Refunds
WERT will refund, by the method in Section 9, in the following cases:
7.1 Duplicate payment: once verified, WERT promptly refunds the duplicated amount in full, with no deduction.
7.2 Incorrect amount charged: if the amount collected exceeds the amount agreed in the quotation/contract, WERT promptly refunds the difference in full.
7.3 WERT cannot provide the service and nothing has been delivered: for example, the property is outside our service area, we cannot field a crew or source materials, or a site survey shows the agreed work cannot be performed — full refund of everything received. WERT will normally contact you to confirm an appointment within 2 business days of receiving your payment; and if WERT has not confirmed an appointment within 14 calendar days of your payment, you may immediately choose between a firm service date and a full refund by notifying WERT through the channels in Section 13.1 — WERT's normal practice is also to contact you to offer that choice (mirroring Section 4.3 of the WERT Terms & Conditions of Service).
7.4 Mutually agreed cancellation: refund in the amount and on the terms agreed in writing.
7.5 Refunds required by law: including exercise of the 7-day statutory cancellation right under Section 8 (Direct Sales and Direct Marketing Act B.E. 2545) and any other case in which the law requires WERT to refund — statutory rights that this Policy does not displace.
7.6 Other cases WERT approves: WERT may refund in special cases as a matter of customer care. Case-by-case approval does not create a binding precedent for other cases.
Section 8 — 7-Day Statutory Cancellation Right for Purchases under the Direct Sales and Direct Marketing Act
8.1 Where your purchase falls under the Direct Sales and Direct Marketing Act B.E. 2545 (2002) (for example, orders placed and paid through the online channel once available, including payment via a personal payment link, where that Act applies to the purchase), you may cancel the contract by written notice within 7 days of receiving the service, under Section 33 of that Act. This is a statutory right that this Policy does not displace, limit, or make subject to any additional condition.
8.2 How to exercise the right: give written notice of cancellation through the channels in Section 13.1 (email contact@wert.in.th or LINE Official: @WERT is recommended, so the notice date is clear), stating your name, the order/receipt number, and the payment date. The refund deadline runs from the date WERT receives your cancellation notice.
8.3 Refund deadline: WERT will refund within 15 days of receiving your cancellation notice, as required by Section 36 of that Act.
8.4 Relationship to Section 3: the stage deductions (A–F) in Section 3 do not apply to a lawful cancellation under this Section, except for any set-off the law permits.
Section 9 — Refund Method
9.1 Original payment channel (wherever possible): (a) Paid by card → refunded only to the same card used to pay, through the payment service provider / card network (card payments are not refunded in cash or by transfer, as that would breach card-network rules and anti-money-laundering standards). A card refund is always submitted to the original card, even if that card has since been closed or replaced — the issuing bank normally redirects the funds to your new card or account; if that fails, Section 9.1(d) applies. (b) Paid by bank transfer → refunded to the originating account, with the account name verified against the payer. (c) Paid in cash → refunded by transfer to a bank account in the payer's name, with identity verification and a signed refund acknowledgment. (d) For bank-transfer and cash payments: if the original account genuinely no longer exists (e.g., it has been closed), WERT will refund to another verified account in the same person's name and document the reason. For card payments: WERT will refund by transfer to a verified account in the cardholder's name only where the payment service provider confirms in writing that a credit to the original card can no longer be processed (for example, because the refund window for the original transaction has lapsed), and WERT retains that confirmation as evidence.
9.2 WERT's responsibility is for the THB amount. WERT is responsible for refunding the approved Thai Baht (THB) amount in full and does not deduct payment-processing fees from the approved amount. Exchange-rate differences and card-issuer fees are a matter between you and your issuer, as described in Section 10.
9.3 Timing. Once a refund is approved, WERT will submit the refund instruction to the bank or payment service provider within the time set under Section 13.3. After the instruction is submitted, the time for funds to reach you depends on the payment service provider, the card network, and your issuing bank, and is outside WERT's control (card refunds commonly take about 5–10 business days to appear on a card account — general information, not a commitment). WERT will provide refund reference evidence (such as the transaction reference number) on request.
9.4 Where the law prescribes a specific refund deadline (such as the 15 days under Section 8), the statutory deadline governs.
Section 10 — Foreign-issued Cards and Currency Conversion
10.1 WERT prices and charges in Thai Baht (THB) only and does not offer point-of-sale currency conversion (no Dynamic Currency Conversion). The amount shown on your statement in your own currency results from conversion by the card network and your issuing bank at the issuer's rates and policies, which may include a foreign transaction fee and a currency-conversion fee set by your issuer.
10.2 Card refunds are made in THB, in the approved amount, to the same card. Your issuing bank converts the refund to your currency at the exchange rate on the refund processing date, which may differ from the rate on the payment date. The amount you receive back in your own currency may therefore be more or less than the amount originally billed, and issuer fees may or may not be returned under your issuer's own policy. These differences are not a defect in the refund and are not WERT's responsibility.
10.3 Illustration (all figures hypothetical, for explanation only): you pay THB 20,000 with a card issued in the United States. • On the payment date, at an assumed rate of THB 36.00 per USD, your issuer bills approximately USD 555.56, possibly plus a foreign transaction fee (e.g., at 2%, approximately USD 11.11), for a total of approximately USD 566.67. • WERT later refunds the full THB 20,000. If the rate on the refund processing date is THB 37.00 per USD, you receive back approximately USD 540.54; if the rate is THB 35.00 per USD, you receive back approximately USD 571.43. • Any fee your issuer originally charged may or may not be returned, under the issuer's own policy. In every case, WERT's refund is complete when the full approved THB amount — THB 20,000 — has been refunded.
10.4 For questions about exchange rates or card fees, please contact your issuing bank, which alone sets those rates and policies.
Section 11 — Payment Disputes and Chargebacks
11.1 Contact WERT first. If you see a charge that looks wrong or unfamiliar, or you are dissatisfied with the service, you agree to contact WERT through the channels in Section 13.1 and allow WERT 7 days to investigate and resolve the issue before initiating a dispute with your bank or card issuer. Nothing in this agreement limits your statutory rights or your rights under the card networks' rules (see Section 11.2). Most issues (wrong amounts, duplicates, an unrecognized merchant descriptor on your statement, defects in the work) can be checked and put right far faster than a bank process.
11.2 Your rights remain intact. The contact-first commitment in Section 11.1 exists for speed of resolution only. Nothing in this Policy removes or limits your statutory rights or your right to dispute a transaction through your card issuer under the card networks' rules.
11.3 A chargeback is not a WERT refund. A chargeback runs between the issuing bank, the card network, and the payment service provider, on their own timelines. Filing a chargeback while WERT is already processing your refund can delay your money. Where WERT has already refunded, you will receive reference evidence you can give your bank immediately. Once a chargeback has been filed with your issuer, WERT is required to suspend any pending refund and respond through the card network's dispute process instead; the outcome is then determined by that process.
11.4 WERT's right to respond with evidence. When a chargeback is filed, WERT is entitled to present the facts to the bank and card network through its payment service provider, submitting relevant evidence to the extent the law allows, which may include: the quotation; the invoice/receipt; payment confirmation; the IP address and device data recorded when the order was placed or the terms accepted; the timestamp and version of the terms accepted; the service address; appointment records and confirmations; message correspondence (e.g., LINE/email); site photographs; service reports; evidence of site attendance including location (GPS) data to the extent the law allows; signatures and handover documents; before-and-after photographs; and follow-up visit records. Collection and use of this data is governed by WERT's Privacy Policy (on the bases of contractual performance and legitimate interests in establishing and defending legal claims).
11.5 Claims of "unrecognized transaction" where the service was received. Where the evidence shows that the service was ordered, received, and confirmed as satisfactory, but a chargeback is later filed claiming the transaction was unrecognized or unauthorized, WERT will fully exercise its right to contest that dispute with the evidence described in Section 11.4. Only where a chargeback is filed fraudulently or in bad faith, with knowledge that the charge was proper, and causes WERT loss, does WERT reserve the right to claim the damages actually suffered, only as far as Thai law permits and only through lawful process — WERT imposes no flat "chargeback penalty" on customers.
11.6 WERT handles every dispute professionally and without prejudice, and will refund promptly whenever the facts show you are entitled to a refund under this Policy or the law.
Section 12 — Unauthorized or Fraudulent Transactions
12.1 If you find a charge from WERT that you did not make (for example, your card or account was used by someone else): (a) contact your bank or card issuer immediately to block or suspend the card; and (b) notify WERT through the channels in Section 13.1 with whatever transaction details you have, so WERT can investigate and place any related service on hold.
12.2 How WERT treats genuine fraud victims. WERT will investigate promptly, suspend any service not yet delivered, cooperate fully with the issuing bank, the payment service provider, and law-enforcement officials, and — where it verifies that a transaction was fraudulent and no service has been delivered — will refund/void the transaction on WERT's side without waiting for other processes to conclude. You may also report the matter to the police, and in Thailand to the Anti-Online-Scam Operation Center (AOC hotline 1441).
12.3 WERT-side safeguards. To prevent fraud, WERT reserves the right to verify identity or card authorization for transactions showing unusual characteristics, to pause commencement of work during verification, and to refund and decline orders reasonably believed to be unlawful, notifying the payer in each case.
Section 13 — How to Request a Refund
13.1 Channels: LINE Official: @WERT · Email contact@wert.in.th · Tel. +66 81 968 2294. All channels are equally valid; a written channel is recommended so the notice date is clear.
13.2 Information to include: your full name and contact number · quotation/contract/receipt number (if available) · payment date and amount · payment channel with evidence (e.g., transfer slip, or the last four digits of the card — never send a full card number or CVV) · the reason for the request · for transfers: the original destination account for receiving the refund.
13.3 Process and normal timelines (items (4) and (5) are binding deadlines in every case): (1) WERT normally acknowledges the request within 2 business days of receiving it; (2) WERT normally notifies its decision, with the amount and the calculation method, within 5 days of receiving complete information; if WERT needs further information, it will request it promptly, aiming to cover everything in one request; (3) once approved, WERT normally submits the refund instruction to the bank or payment service provider within 2 days of approval, and never later than any statutory deadline; (4) Hard backstop for card payments: in every case where a refund is approved or a cancellation is accepted, WERT submits the card credit no later than 14 calendar days after receiving the cancellation/refund request, regardless of internal process stage; (5) Statutory path — 7-day cancellation under the Direct Sales and Direct Marketing Act B.E. 2545 (Section 8): WERT refunds within 15 days of receiving the written cancellation notice, independently of every other timeline in this Section.
13.4 The decision: WERT gives its decision in writing. If costs are deducted, the itemization and evidence required by Section 3.4 are attached. If the request is declined, WERT states the reasons and the contractual/legal grounds relied on.
13.5 If you disagree: you may ask for one further review with additional reasons. This does not affect your right to complain to the Office of the Consumer Protection Board (OCPB hotline 1166), to bring proceedings under the Consumer Case Procedure Act B.E. 2551 (2008), or to dispute the transaction through your card issuer.
Section 14 — Policy Versions and Which Version Applies
14.1 This Policy always displays its version number and effective date in the header. WERT retains every historical version, and you may request a copy of any earlier version through the channels in Section 13.1.
14.2 The version that applies to your transaction is the version in force at the time you paid for that transaction. Later amendments do not apply retroactively to payments already made, unless the amendment gives you greater rights.
14.3 When WERT opens online payment, the checkout will present this Policy (or a summary with a link) at the payment step before you confirm, and will record the policy version, the date and time, and your acceptance as part of the transaction record. The same applies to payment via a personal payment link WERT sends to you: the link always opens WERT's payment-confirmation page before proceeding to payment.
14.4 Material amendments will be announced on wert.in.th with their effective date. Amendments affecting contracts still within their term will be announced at least 30 days before they take effect, and an amendment that reduces your rights will not apply to that contract until its next renewal.
